By accessing and using BrewMap (the "Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use BrewMap. Your continued use of the Service constitutes your acceptance of these terms and any updates we make to them.
Description of Service
BrewMap is a mobile and web application that provides:
- Café Discovery: Locate and explore coffee shops based on location, ratings, and reviews
- Drink Ratings: Rate and review beverages at different establishments
- Academy Courses: Educational content about coffee brewing, history, and culture
- Interactive Tools: Features to enhance your coffee learning and discovery experience
- Gamification: Earn achievements, track progress, and compete with other users
User Accounts
To use certain features of BrewMap, you may be required to create an account. You agree to:
- Provide Accurate Information: Ensure all information you provide is truthful and complete
- Account Security: Maintain the confidentiality of your password and be responsible for all activity under your account
- One Account Per Person: Each person may create only one account. Accounts may not be shared or transferred
- Legal Age: If you are under 18, you must have parental or guardian consent to use BrewMap
Acceptable Use
You agree not to use BrewMap for any unlawful or prohibited activities, including but not limited to:
- Submitting false or fraudulent reviews and ratings
- Spamming, flooding, or harassing other users
- Engaging in threats, defamation, or offensive behavior
- Scraping, crawling, or automated collection of data from BrewMap
- Attempting to reverse engineer, decompile, or hack BrewMap's infrastructure
- Using BrewMap for commercial purposes without explicit permission
- Violating any applicable laws or regulations
User Content
When you submit reviews, ratings, or other content to BrewMap ("User Content"), you grant BrewMap a worldwide, non-exclusive, royalty-free license to use, display, and distribute that content.
- Ownership: You retain ownership of your User Content
- License to BrewMap: By posting, you grant us permission to display your content publicly on BrewMap and in our marketing materials
- Content Removal: We may remove User Content that violates these Terms or our community guidelines without notice
- No Confidentiality: By submitting User Content, you acknowledge it is not confidential
Academy Content
The educational courses, materials, and content available in the BrewMap Academy ("Academy Content") are provided for your personal, non-commercial use only. You agree:
- Not to redistribute, copy, or share Academy Content with others
- Not to commercially exploit Academy Content without written permission from BrewMap
- Not to upload Academy Content to third-party platforms without authorization
- Academy Content is provided as educational material and should not be used as professional advice
Intellectual Property
BrewMap, including its name, logo, design, interface, functionality, and all content (including Academy Content), are the exclusive property of Flowtel AI. All rights are reserved. You may not:
- Use BrewMap's name, logo, or trademarks without permission
- Modify, reproduce, or create derivative works from BrewMap
- Copy or distribute BrewMap's design or content
Disclaimers
BrewMap is provided "as is" and "as available" without warranties of any kind, either express or implied. Specifically:
- No Accuracy Guarantee: We do not guarantee the accuracy of café listings, hours, ratings, or reviews
- Educational Content Not Professional Advice: Academy content is for educational purposes only and should not be considered professional advice from a certified expert
- No Service Guarantee: We do not warrant that BrewMap will be uninterrupted, error-free, or secure
- Third-Party Content: We are not responsible for the accuracy or quality of user-submitted content
Limitation of Liability
To the maximum extent permitted by law, BrewMap and Flowtel AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service. Our maximum liability to you is limited to the amount you have paid for BrewMap services. For free users, our liability is zero.
Termination
We may suspend or terminate your account at any time for violations of these Terms or for any reason at our sole discretion. Upon termination, your right to use BrewMap immediately ceases. You may delete your account and associated data at any time by contacting support@brewmap.coffee.
Dispute Resolution
Any disputes arising from these Terms or your use of BrewMap will be resolved as follows:
- Informal Resolution: We encourage you to contact us first to attempt informal resolution
- Binding Arbitration: If informal resolution fails, disputes will be settled by binding arbitration rather than in court
- Governing Law: These Terms are governed by the laws of California, without regard to conflict of law provisions
Changes to Terms
We reserve the right to modify these Terms of Service at any time. For material changes, we will provide you with at least 30 days' notice via email or through the BrewMap application. Your continued use of BrewMap after such modifications constitutes your acceptance of the updated Terms.
